1) About OrayBest

OrayBest is a made-to-order sweets studio serving customers across Canada. We craft custom cakes, cupcakes, macarons and dessert tables. For how we handle personal information, see our Privacy Policy.

2) Eligibility & Accounts

You must be the age of majority in your province/territory to place orders. If you create an account (where available), you are responsible for maintaining the confidentiality of your credentials and for all activities under your account.

3) Orders & Quotes

• Quotes. Quotes are estimates based on details you provide (size, servings, design, delivery). Final pricing may vary if details change.
• Design approvals. We may share sketches or references for complex designs. Your approval constitutes authorization to proceed.
• Availability. All orders are subject to availability and booking schedule.

4) Pricing & Payment

• Prices are in Canadian dollars (CAD) unless stated otherwise and may change without notice.
• We accept major cards and Interac e-Transfer. Taxes and delivery fees apply where applicable.
• Deposit. A non-refundable deposit (typically 50%) may be required to secure your date.
• Outstanding balances must be paid before pickup/delivery.

5) Changes, Cancellations & Refunds

• Minor changes may be possible up to 72 hours before your event; complex designs may require more notice.
• Cancellations made after ingredients have been purchased or work has begun may forfeit the deposit and incur costs for work performed.
• Because our products are perishable and custom-made, refunds are assessed case-by-case for quality issues reported promptly (with photos, where relevant).

6) Delivery, Pickup & Risk of Loss

• We offer Canada-wide delivery with chilled packaging for suitable items; fragile sculpted designs may be limited to local delivery or pickup.
• Delivery windows are estimates; please ensure someone is available to receive the order.
• Risk of loss passes upon delivery or pickup. Keep items level, chilled as instructed, and out of direct sunlight.

7) Allergens & Dietary Requests

We offer vegan, gluten-free, and reduced-sugar options on request. While we follow careful practices, our kitchen may handle common allergens (e.g., nuts, dairy, eggs, wheat). Trace allergens may be present. Please inform us of any allergies when ordering.

8) Photos, Designs & Intellectual Property

• We may photograph finished products for our portfolio and social media. If you prefer we do not, please tell us in writing when booking.
• Designs we create remain our intellectual property. You may not reproduce them commercially without our consent.
• If you provide images, logos, or text, you represent that you have the right to use and share them with us for your order.

9) User Content & Acceptable Use

• Do not upload unlawful, infringing, hateful, or harmful content.
• Do not interfere with site operation, attempt to access non-public areas, or introduce malware.
• We may remove or refuse content at our discretion and report unlawful activity to authorities.

10) Disclaimers & Limitation of Liability

We provide our site and services on an “as is” and “as available” basis to the extent permitted by law. To the maximum extent allowed, OrayBest and its owners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from or related to your use of our site or products. Nothing in these Terms limits liability that cannot be limited under applicable law.

11) Indemnity

You agree to indemnify and hold OrayBest harmless from claims, damages, and expenses (including reasonable legal fees) arising from your violation of these Terms or misuse of our services.

12) Governing Law & Dispute Resolution

These Terms are governed by the laws of the Province of Ontario and applicable Canadian federal laws, without regard to conflict-of-laws rules. You agree to the exclusive jurisdiction and venue of the courts located in Toronto, Ontario, for any disputes not subject to informal resolution.

13) Changes to these Terms

We may update these Terms from time to time. The “Last updated” date at the top indicates the latest revision. Material changes will be highlighted on this page. Your continued use of our site after changes constitutes acceptance.
